Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of Make Questions, a question-generation, study, assessment, and export service operated by Karson AI, Inc.(“we,” “us,” or “our”).

By accessing or using the Service, creating an account, starting a subscription, or exporting materials, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and Educational Use

The Service is intended for users who are at least 13 years old. It is not directed to children under 13, and we do not knowingly permit children under 13 to create accounts or submit personal information.

If you use the Service on behalf of a school, classroom, organization, student, or other person, you are responsible for having the authority and any required notices, permissions, or consents needed for that use.

Accounts and Security

Some features require an account. You are responsible for keeping your login credentials secure, maintaining accurate account information, and all activity that occurs under your account.

You must notify us promptly at hello@karson.ai if you believe your account has been compromised or used without authorization.

Access to the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for creating, reviewing, saving, sharing, and exporting educational questions and related materials.

We and our licensors retain all rights in the Service, including its software, design, branding, documentation, models, workflows, and other materials, except for rights you retain in your own content and outputs as described below.

Your Content and Generated Output

You may submit text, prompts, files, URLs, preferences, answers, feedback, and other materials to the Service (“Input”). The Service may generate questions, answers, explanations, exports, titles, summaries, or other materials based on your Input (“Output”).

As between you and us, you retain rights you already have in your Input. We assign to you our rights, if any, in Output generated for you, subject to these Terms, applicable law, third-party rights, and the rights needed for us and our service providers to operate the Service.

You grant us a limited license to host, process, transmit, display, reproduce, and otherwise use your Input and Output as needed to provide, secure, maintain, troubleshoot, and improve user-facing features of the Service.

AI-Generated Materials

The Service uses artificial intelligence and other automated systems. Output may be incomplete, inaccurate, duplicated, biased, unsuitable for a specific learner, or otherwise inappropriate for your intended use.

You are responsible for reviewing, editing, and verifying Output before using it in a classroom, assessment, publication, public share, or other setting. The Service does not provide legal, professional, academic, or educational certification advice.

We do not use Google User Data obtained through Google APIs to train, retrain, or fine-tune AI or machine-learning models.

Saved Sessions, Public Sharing, and Exports

The Service may let you save question sessions, copy or fork shared sessions, publish public links, download files, or export selected questions to formats such as PDF, Word, Google Docs, or Google Forms.

You are responsible for the content you save, publish, share, distribute, or export, including ensuring that you have the rights to use any source material and that shared materials do not disclose confidential, personal, student, or third-party information without authorization.

Public links may be accessible to anyone who receives or discovers the link. Do not publish or share content that you are not authorized to make public.

Public sessions that meet our indexing criteria may be included in public sitemaps or otherwise become discoverable by search engines and other crawlers.

Google Export and Third-Party Integrations

If you connect your Google account, the Service may use Google APIs to create Google Docs and Google Forms that you request and to update those newly created files with your selected questions. Some Google scopes, including the Google Forms scope, may technically permit broader access than our export workflow uses. We do not intentionally read, modify, or delete unrelated existing Google documents or forms.

Third-party services such as authentication, payment processing, analytics, hosting, storage, AI generation, and Google APIs are governed by their own terms and privacy policies. We are not responsible for third-party services outside our control.

Subscriptions, Billing, and Taxes

Paid plans are billed through Stripe-hosted checkout and billing management. By purchasing a paid plan, you authorize Stripe and us to charge the applicable subscription fees, taxes, and other disclosed charges.

Subscriptions renew automatically unless cancelled before the next billing period through the billing portal or another method we make available. Plan features, limits, prices, and billing intervals may change with reasonable notice where required.

Except where required by law or expressly stated at checkout, payments are non-refundable. We may issue refunds at our discretion.

Acceptable Use

You may not use the Service to:

  • Violate any law, regulation, contract, intellectual property right, privacy right, or third-party right
  • Upload or generate unlawful, harmful, abusive, discriminatory, sexually exploitative, deceptive, or harassing content
  • Submit personal, student, confidential, or sensitive information without authorization and required consent
  • Interfere with, overload, scrape, probe, reverse engineer, or bypass limits or security controls of the Service
  • Share account credentials, resell access, or use the Service to compete with us without written permission
  • Use Output as a substitute for professional judgment or required review in high-stakes educational, legal, medical, financial, or safety settings

Privacy

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. By using the Service, you acknowledge that we process information as described in our Privacy Policy.

Service Availability and Changes

We may modify, suspend, discontinue, or limit the Service or any feature at any time. We do not guarantee that the Service will be uninterrupted, error-free, secure, available in every location, or that any content will be preserved indefinitely.

We may apply usage limits, rate limits, feature limits, storage limits, or other safeguards to protect the Service and manage plan entitlements.

Disclaimers

The Service and all Output are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

Limitation of Liability

To the fullest extent permitted by law, Karson AI, Inc. and its officers, directors, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, content, or use, arising from or related to the Service or these Terms.

To the fullest extent permitted by law, our total liability for all claims relating to the Service or these Terms will not exceed the greater of the amount you paid us for the Service in the three months before the event giving rise to the claim or one hundred U.S. dollars.

Indemnity

You will indemnify and hold harmless Karson AI, Inc.and its officers, directors, employees, contractors, agents, affiliates, and service providers from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your Input, Output, public shares, exports, use of the Service, violation of these Terms, or violation of law or third-party rights.

Suspension and Termination

We may suspend or terminate access to the Service if we reasonably believe you violated these Terms, created risk for the Service or others, failed to pay fees, or used the Service in a way that may expose us or others to liability.

You may stop using the Service at any time. To request account or data deletion, contact us at hello@karson.ai. Some information may be retained where required or permitted by law, for security, billing, dispute resolution, backup, or legitimate business purposes.

Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice by posting the updated Terms, updating the date above, or using another reasonable method. Your continued use of the Service after changes become effective means you accept the updated Terms.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You and Karson AI, Inc. agree to the exclusive jurisdiction and venue of the state and federal courts located in California for disputes arising out of or relating to these Terms or the Service, unless applicable law requires otherwise.
